Kerry Kennedy is at North Castle Justice Court Tuesday evening to answer a charge of driving while ability impaired.
Kennedy will be arrainged on the charge, Lucian Chalfen, a spokesman for the Westchester County District Attorney told Patch. She is a Bedford resident, former wife of Gov. Andrew Cuomo and daughter of the late Robert F. Kennedy.
There has been intense and speculation as to what caused the alleged incident, which state police claim involved her vehicle having a hit and run with a tractor trailer Friday morning on the North Castle stretch of Interstate 684, near Armonk. Media reports have brought up suggestions that perhaps the prescription drug Ambien impaired her judgment.
Her brother, Douglas Kennedy, is skeptical about what has been reported since Friday.
He said that, "she certainly wasn't purposely taking Ambien at 8 a.m.," to go work out at the gym.

Robert Gottlieb, attorney for Kerry and Douglas Kennedy, told The Journal News that she will plead not guilty at her court date. Court, which is located in the area of the North Castle town hall building in Armonk, starts at 6 p.m.
“The timing is just really unfortunate,” Gottlieb told the paper, referencing the death of sister-in-law and fellow Bedford resident Mary Richardson Kennedy, who was a longtime friend of hers.
Douglas Kennedy, a Chappaqua resident, told Patch that it's been "an awful couple of months for Kerry," with Mary Richardson Kennedy's death being a reason.
With regards to published reports of possible Ambien usage, Gottlieb declined to get into the matter in his Journal News interview.
Maj. Michael Kopy of Troop K of the New York State Police, declined to comment to Patch about the Ambien reports. Chalfen did not have a response to the published claim, either.
Meanwhile, Kennedy is scheduled to overgo a medical evaluation in connection to the incident, The Journal News reported, looking at whether scenarios such as fainting or a seizure may have been involved.
